Free product for minimum spend not on sale

Hello,
I use a coupon, for 250 € minimum purchase I offer a free product, excluding promotion. If the customer adds to the basket a product has 280 € on promotion + an item has 2 € excluding promotion, the promo code applies! Yet I checked the box “Check this box if the coupon should not apply to items on sale”
Is this a bug or something wrong?

Use ‘minimum subtotal of matching products’ instead of ‘minimum spend’.
